Terms and Conditions

1. Scope

The following terms and conditions apply to all orders placed through our online shop by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession. A business is a natural or legal person or a partnership with legal capacity that acts in the course of its trade or self-employed professional activity when concluding a legal transaction.

For businesses, the following applies: If the business uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they will only become part of the contract if we have expressly agreed to them.

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with Bertani Fuchs Rodriguez Garcia GbR.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products into your cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods contained in your cart by clicking the order button. Immediately after sending your order, you will receive a confirmation by email.

The language(s) available for the conclusion of the contract: German, English

We store the contract text in our systems, which are not accessible to you.

4. Delivery Conditions

Delivery Options

We deliver the products to the delivery address specified during the order process.

Delivery is only available via shipping. Self-collection of the goods is not possible.

5. Payment

The following payment methods are generally available in our shop:

Credit card, Debit card
During the ordering process, you provide your credit or debit card details. Your card will be charged immediately after placing the order.

PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment instruction. The payment transaction will be executed by PayPal immediately after placing the order. Further information is provided during the ordering process.

PayPal may offer additional payment methods to registered and selected customers in their accounts. We have no influence on the offering of these options; any additional payment options are subject to your legal relationship with PayPal. More information can be found in your PayPal account.

To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have an online banking-enabled bank account, identify yourself accordingly, and confirm the payment instruction. Your account will be debited immediately after placing the order. Further information is provided during the ordering process.

6. Right of Withdrawal

Consumers have the statutory right of withdrawal as described in the cancellation policy. Businesses are not granted a voluntary right of withdrawal.

7. Transport Damage

For consumers: If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us immediately. Failure to file a complaint or make contact has no consequences for your statutory rights and their enforcement, particularly your warranty rights. However, you help us assert our own claims against the carrier or transport insurance.

9. Liability

We are always fully liable for claims due to damages caused by us, our legal representatives, or agents

  • in case of injury to life, limb, or health,
  • in case of intentional or grossly negligent breach of duty,
  • in case of guarantee promises, if agreed, or
  • if the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on which the contracting party may regularly rely (cardinal obligations), due to slight negligence by us, our legal representatives, or agents, liability is limited to the foreseeable damage typical for the contract at the time of its conclusion.
Otherwise, claims for damages are excluded.

The food items included in our boxes may contain traces of various allergens and other substances. Although we take the utmost care in compiling our boxes, we cannot guarantee that they are free from any allergens or potentially harmful substances.
It is the customer's responsibility to ensure that the products are suitable for their individual needs and requirements, particularly in regard to food allergies, intolerances, and sensitivities. We accept no liability for health problems or damage caused by the consumption of our products.
The information on our website is for informational purposes only and does not constitute professional advice. We recommend that customers with specific health concerns consult a doctor or nutritionist before consuming our products.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

11. Youth Protection

If your order includes products that are subject to age restrictions, we use a reliable process involving a personal identity and age verification to ensure that the purchaser has reached the required minimum age. The delivery person will only hand over the goods after a successful age verification and only to the purchaser personally. Delivery to parcel lockers is not possible in this case.
